Ms. Gallegos' advocacy in San Juan City College v. U.S. caused the U.S. Court of Appeals for the Federal Circuit to recognize for the first time the right of colleges to sue the U.S. Department of Education (ED) for damages for breach of contract. Never before had a court of law ruled that a postsecondary institution could sue the ED for damages. Before the decision, it had been commonly accepted that the only monetary relief an institution could receive where the ED failed to meet its legal obligations to an institution was reimbursement for funds the institution had advanced to eligible students. The decision expanded the rights of schools in an unprecedented way through an appellate challenge.
